These Terms and Conditions ("Terms") govern your access to and use of the Limbico mobile application, website, and related services (collectively, the "Service").
The Service is provided by CLICK GENERATION S.R.L. S.B., with registered office at Piazza IV Novembre 4, 20124 Milan, Italy, VAT number IT12373690960, Milan Companies Register number MI2657735 ("Click Generation", "Limbico", "we", "us", or "our").
By creating an account, accessing, or using the Service, you confirm that you have read and agree to these Terms. If you do not agree, you must not use the Service.
1. Eligibility
You must be at least 18 years old to create an account or use Limbico. Limbico is not offered to minors, including with parental or guardian consent.
You must provide accurate information when creating an account and keep your account information up to date. You are responsible for protecting your login credentials and for activity carried out through your account. Please notify us promptly if you suspect unauthorized access.
2. The Limbico Service
Limbico is a wellness application that may provide features such as:
personalized wellness and Mind Scores;
analysis of sleep, activity, heart rate, heart rate variability, and other supported biometric information;
AI-generated insights and conversations;
wellbeing questionnaires and self-assessment tools;
breathing exercises and wellness suggestions;
optional calendar and location-based context;
integrations with Apple Health and supported third-party wearable providers;
notifications, trends, streaks, and social features; and
free-trial and paid subscription features.
Some features require a compatible device, an internet connection, an active account, specific device permissions, or a supported third-party service. Features may vary depending on your device, region, subscription status, and the data you choose to provide.
3. Wellness and Medical Disclaimer
Limbico is intended solely for general wellness, informational, and educational purposes.
Limbico is not a medical device or healthcare service. It is not intended to diagnose, treat, cure, monitor, or prevent any disease, disorder, or medical condition. Mind Scores, stress indicators, questionnaire results, AI responses, insights, and suggestions do not constitute medical advice, diagnosis, or treatment.
Information provided by Limbico may be incomplete, inaccurate, delayed, or unsuitable for your individual circumstances. You must not use the Service as a substitute for advice from a qualified physician, psychologist, psychotherapist, or other healthcare professional. Do not disregard or delay professional advice because of information provided by Limbico.
Limbico is not an emergency or crisis-response service and is not continuously monitored by healthcare professionals. If you believe that you or another person may be in immediate danger, may harm themselves or someone else, or may be experiencing a medical or mental-health emergency, contact the appropriate local emergency services immediately.
4. AI-Generated Content
Certain parts of the Service use artificial intelligence to generate conversations, summaries, observations, or personalized wellness insights based on information available to the Service.
AI-generated content:
may contain errors, omissions, or inappropriate conclusions;
is not guaranteed to be accurate, complete, current, or suitable for a particular purpose;
may not be reviewed by a human before it is shown to you; and
must not be relied upon for medical, legal, financial, safety-critical, or other professional decisions.
You remain responsible for evaluating AI-generated content and for decisions you make based on it. We may use specialist service providers, including AI and memory-processing providers, to operate these features as described in our Privacy Policy.
5. Health Data, Device Permissions, and Wearable Integrations
With your permission, Limbico may access supported health, fitness, calendar, location, and device information. You decide whether to grant or withdraw these permissions through Limbico, your device settings, Apple Health, or the relevant third-party provider.
You may connect supported services and devices such as Apple Health, Garmin, Fitbit, Oura, Whoop, Polar, Withings, Samsung Health, Google Health, and other providers made available through our integration partners. Availability may change over time.
Data received from devices and third-party providers may be inaccurate, incomplete, delayed, unavailable, or affected by device settings and provider outages. Limbico does not control and is not responsible for the accuracy of third-party measurements or for the independent operation of third-party services.
You must comply with the terms of any third-party service you connect. You may disconnect supported integrations through the available app or provider controls.
6. Privacy
Our collection and processing of personal data are described in the Limbico Privacy Policy, available at:

Please read the Privacy Policy carefully. Accepting these Terms does not by itself constitute consent to any processing for which applicable law requires separate consent. Where required, Limbico will request your permission or consent before accessing or processing health, wearable, calendar, location, or other protected data. You may withdraw optional permissions or consent through the available app, device, or provider controls, although doing so may prevent the related feature from working.
7. Your Content and Conduct
"Your Content" includes information you submit to the Service, such as profile information, messages, questionnaire responses, feedback, and other material you choose to provide.
You retain any rights you hold in Your Content. You grant us a limited, non-exclusive license to host, process, reproduce, and transmit Your Content only as reasonably necessary to operate, secure, and maintain the Service, comply with the law, and provide features you request, subject to our Privacy Policy. This clause does not authorize us to use your conversations or health data to train general-purpose AI models.
You must not:
use the Service for unlawful, fraudulent, abusive, threatening, or harmful purposes;
submit content that violates another person's rights;
impersonate another person or misrepresent your identity;
attempt to access another user's account or non-public parts of the Service;
interfere with the Service, bypass security measures, introduce malicious code, or overload our systems;
reverse engineer, decompile, or extract source code except where applicable law expressly permits it;
scrape, copy, resell, sublicense, or commercially exploit the Service without our written permission; or
use the Service or its outputs to make automated medical, employment, insurance, credit, or other high-impact decisions about another person.
We may remove content or restrict activity where reasonably necessary to protect users, the Service, or third parties, or to comply with legal obligations.
8. Friends and Social Features
If you use Limbico's Friends or similar social features, information such as your display name, Mind Score, trends, or streak may be visible to people you intentionally connect with, as described in the app and Privacy Policy.
Only connect with people you trust. You must not use social features to harass, monitor, pressure, or harm another person. You can remove connections using available app controls.
9. Free Trial
Eligible new users may receive a 30-day free trial without providing payment information. Unless a different offer is clearly displayed, the trial does not automatically convert into a paid subscription.
We may change eligibility or duration for future trials. We will not shorten an active trial except where reasonably necessary to address fraud, misuse, a legal requirement, or a security risk. Promotional access and offer codes may be subject to additional conditions displayed when offered.
10. Paid Subscriptions
Limbico may offer an automatically renewing monthly subscription. The applicable price, currency, billing period, included features, and any offer terms are displayed before purchase.
When you subscribe through Apple's App Store:
payment is charged to your Apple Account;
the subscription renews automatically unless canceled before the next renewal in accordance with Apple's applicable rules;
you can manage or cancel the subscription through your Apple Account subscription settings;
deleting Limbico or deleting your Limbico account does not automatically cancel an App Store subscription;
purchases may be restored using the restore-purchases function where available; and
billing, cancellation, refunds, and payment disputes are administered by Apple under its applicable terms and policies.
Where purchases through another authorized platform become available, that platform's disclosed billing and cancellation terms will apply.
Refund requests are handled under the rules of the payment platform through which the purchase was made. Nothing in these Terms limits any mandatory refund, withdrawal, conformity, or other consumer right available under applicable law.
We may change subscription prices or features prospectively. Any price change will be communicated and take effect in accordance with the rules of the relevant payment platform and applicable law.
11. Apple App Store Terms
If you obtained Limbico through Apple's App Store, your license to use the application is also subject to Apple's Standard Licensed Application End User License Agreement ("Apple Standard EULA"), unless a valid custom EULA applies:

These Terms govern your Limbico account and use of the Service. The Apple Standard EULA governs the license to the iOS application where applicable. If there is a conflict concerning that application license, the Apple Standard EULA controls to the extent of the conflict.
You acknowledge that:
these Terms are between you and Click Generation, not Apple;
Click Generation, not Apple, is responsible for providing the Service and any support we expressly offer;
Apple has no obligation to provide maintenance or support for the Service;
Apple is not responsible for claims relating to the Service except where required by applicable law; and
Apple and its subsidiaries are third-party beneficiaries of the App Store provisions in these Terms and may enforce those provisions against you.
You represent that you are not located in a country or region subject to an applicable government embargo that prohibits your use of the Service and are not included on an applicable government list of prohibited or restricted parties.
12. Third-Party Services
The Service relies on or may link to third-party platforms, devices, websites, software, and service providers. These may include authentication, cloud hosting, analytics, AI, wearable-data, messaging, and payment providers.
Third-party services are governed by their own terms and privacy notices. We do not control those services and do not guarantee their availability, security, accuracy, or continued compatibility with Limbico. We may change or discontinue an integration if the provider changes its service, permissions, technical requirements, or commercial terms.
13. Intellectual Property
The Service, including its software, design, branding, text, graphics, scoring systems, and other content provided by us, is owned by or licensed to Click Generation and is protected by intellectual-property laws.
Subject to these Terms and any applicable app-store license, we grant you a personal, limited, revocable, non-exclusive, non-transferable right to use the Service for your own non-commercial purposes.
No ownership rights are transferred to you. "Limbico", its logo, and related branding may not be used without our prior written permission.
14. Service Availability and Changes
We aim to keep the Service available and secure, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable because of maintenance, updates, security events, provider outages, technical failures, or circumstances outside our reasonable control.
We may update, add, remove, suspend, or discontinue features where reasonably necessary to improve the Service, maintain security or legal compliance, respond to third-party changes, or protect users. Where a change materially affects a paid Service, we will provide notice where required by applicable law.
15. Suspension, Termination, and Account Deletion
You may stop using Limbico at any time and may request account deletion using the in-app controls or by contacting us.
We may suspend or terminate access where reasonably necessary if:
you materially or repeatedly breach these Terms;
your activity creates a security, legal, or safety risk;
we are required to do so by law or a competent authority; or
continued provision of the Service is no longer reasonably possible.
Where appropriate, we will provide notice and an opportunity to remedy the issue unless immediate action is reasonably required.
Account deletion and data retention are handled as described in our Privacy Policy. Deleting your account does not cancel a subscription purchased through a third-party payment platform.
Provisions that by their nature should continue after termination, including intellectual-property, liability, dispute, and payment provisions, will remain in effect.
16. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis. We do not guarantee that:
wellness scores, AI outputs, device data, or insights will be accurate or complete;
the Service will meet every user's needs;
all features will always be available or compatible with every device; or
the Service will be uninterrupted, secure, or free from defects.
Nothing in these Terms excludes legal guarantees, conformity obligations, or other rights that cannot lawfully be excluded for consumers.
17. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or breach of mandatory consumer rights.
Subject to the paragraph above and to the maximum extent permitted by applicable law, Click Generation will not be liable for indirect or consequential loss, loss of profits, loss of opportunity, or loss resulting from reliance on AI-generated or wellness information where such loss was not reasonably foreseeable.
For paid consumer Services, any monetary limitation of liability will not reduce the remedies and protections that applicable consumer law grants you.
18. Governing Law and Disputes
These Terms are governed by Italian law, without prejudice to any mandatory consumer protections available under the law of the country where you habitually reside.
If you are a consumer, you may bring proceedings before the courts competent under applicable consumer law, including the courts of your place of residence where required. If you are not a consumer, the courts of Milan, Italy, will have exclusive jurisdiction.
Before starting formal proceedings, we encourage you to contact us so that we can try to resolve the matter directly.
19. Changes to These Terms
We may update these Terms to reflect changes to the Service, applicable law, security requirements, or our business operations.
We will provide reasonable notice of material changes through the Service, our website, or email where required. Changes will apply prospectively from the stated effective date. If you do not agree to a material change, you should stop using the Service and may delete your account.
20. General Provisions
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of our right to do so later.
You may not transfer your rights or obligations under these Terms without our consent. We may transfer these Terms as part of a merger, corporate reorganization, financing, or sale of all or part of our business, subject to applicable law and the continued protection of your rights.
These Terms, the Privacy Policy, and any additional terms clearly presented for a specific feature or offer constitute the agreement between you and Click Generation regarding the Service.
